6. ONLINE SHOPPING

6.1. Orders

By submitting an order you are making an offer to enter into an agreement to purchase the goods specified in that order.  An order will be deemed received and accepted by us at the time we send an order confirmation to your nominated e-mail address.

6.2. Payment

Customers are required to make payment in full when making an order.  You represent and warrant that you are authorized to use the method of payment and authorize us to charge your order (including taxes and freight charges) to the card or payment method. If the card (or other method) cannot be verified, is invalid, or is not otherwise acceptable, your order may be suspended or cancelled automatically.

6.3. Availability

We use our best endeavours to ensure products ordered are available.  From time to time this is not possible and we may not be able to fulfil all or part of your order. If the goods are out of stock or unavailable, we will refund you in full the price paid for those unavailable goods. 

6.4. Title and Risk

Title to the goods purchased from SeaSnail does not pass from SeaSnail to you until we have received payment in full for the goods.  All risk in the goods passes to you upon delivery to your address.

7. DISCLAIMER

When placing information onto our website, we aim to ensure that all details, prices, product images and descriptions displayed are correct at the time. However sometimes errors occur, for which we apologise.

Reproduction of colours is as accurate as photographic processes allow, however please note that product colours in-store may vary from what is displayed on your computer monitor and may vary from monitor to monitor and device to device.

Although listed on the website, some items, sizes, colours and styles might not be immediately available or might be temporarily or permanently out of stock.

8. DELIVERY

Delivery time is subject to stock availability from the fulfilment locations. Unless otherwise stated, freight charges are payable in addition to the product price. A number of different delivery methods may be used depending on the type of order.

9. PRICE

All references to $ and dollars on the Australian website are to Australian currency. All prices were current* at the time of publication on the website and are exclusive of GST. SeaSnail may vary the prices at any time and prices are subject to change until you have paid for products in full. 

Unless specified otherwise, all sale and promotional pricing commences at 12:00:01 am (AEST or AEDT when observed) on the promotion start date and ends at 11:59:59 pm (AEST or AEDT when observed) on the promotion end date.

* While we make every endeavour to ensure the accuracy of our website pricing, occasionally there are system or human errors in our pricing.  If this occurs and you have purchased a product at the incorrect price we will advise you as soon as possible and we reserve the right to cancel your order and refund the mistaken purchase price to you.

10. CANCELLATION OF ORDERS

We reserve the right to cancel any order (in full or part) where: (i) you are in breach of these Terms; (ii) SeaSnail reasonably suspects that a fraud has occurred ; (iii) SeaSnail becomes aware after that the goods are unavailable or out of stock;  (iv) there has been a genuine pricing or product description error by SeaSnail or its supplier; (v) there is an error in your order.

We will refund any amount already paid in respect of any cancelled order (and in the case of part cancellation of an order, we will refund the amount paid that relates to the cancelled portion of the order).

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, SeaSnail excludes any liability which may arise as a result of or in connection with: (1) the use, copying, or display of this website and the contents of this site; (2) goods or services supplied by SeaSnail under these Terms; or (3) a failure or omission on the part of SeaSnail to comply with its obligations under these Terms.

For the avoidance of doubt, the above liability limitation does not exclude any rights, which by law may not be excluded, including but not limited to your rights under Australian Consumer Law.
